Welcome to The Story Garden. These Terms and Conditions (“Terms”) govern your use of The Story Garden website and subscription service. By purchasing a subscription or using our services, you agree to these Terms.

1. About Us

The Story Garden is an online subscription service providing personalised bedtime stories for children, delivered digitally by email.

Throughout these Terms:

  • “we”, “our” and “us” refer to The Story Garden.

  • “you” refers to the purchaser or account holder.

  • “child” refers to the child for whom stories are created.

2. Eligibility

Subscriptions may only be purchased by individuals aged 18 or over.

By subscribing, you confirm that you are the child’s parent or legal guardian, or that you have permission from the child’s parent or legal guardian to provide the child’s information for the purpose of creating personalised stories.

3. Our Service

Your subscription includes personalised bedtime stories created using the information you provide, including your child’s first name, age range and favourite interests.

Stories are delivered digitally to the email address you provide.

We aim to deliver stories on the advertised schedule. However, occasional delays may occur due to maintenance, technical issues or circumstances beyond our reasonable control.

4. Your Information

You are responsible for ensuring that the information you provide is accurate and up to date.

If incorrect information is submitted, we cannot guarantee that stories can be amended once they have been created or delivered.

5. Story Content

Every story created through The Story Garden is unique.

We aim to create engaging, imaginative and age-appropriate stories. However, storytelling is subjective and we cannot guarantee that every story will meet every individual preference or expectation.

Parents and guardians remain responsible for deciding whether a story is suitable for their child.

If a story contains an error that has resulted from our mistake, please contact us and we will make reasonable efforts to correct it where possible.

6. Story Requests

We reserve the right to refuse, edit or decline any story request that we reasonably believe is:

  • unlawful;

  • offensive or abusive;

  • discriminatory;

  • sexually explicit;

  • intended to promote harmful behaviour; or

  • otherwise inappropriate for children or inconsistent with the values of The Story Garden.

7. Subscription & Payments

Subscriptions renew automatically each billing period unless cancelled before your next renewal date.

Subscription prices are displayed during checkout.

Payments are processed securely through Stripe.

If payment cannot be collected, we may suspend or cancel your subscription until payment has been successfully received.

8. Price Changes

We may change our subscription prices from time to time.

If we do, we will provide existing subscribers with at least 30 days’ notice before the new price takes effect.

If you do not wish to continue at the new price, you may cancel your subscription before your next renewal date. Your subscription will remain active until the end of your current billing period and no further payments will be taken.

Any price changes will not affect payments that have already been processed.

9. Cancellation, Suspension & Termination

You may cancel your subscription at any time.

If you cancel, your subscription will remain active until the end of your current billing period, after which it will not renew unless you choose to subscribe again.

Refunds are governed by our separate Refund & Cancellation Policy.

Following cancellation, you are welcome to purchase a new subscription at any time through our website.

We reserve the right to suspend or terminate your access to the service if:

  • these Terms are breached;

  • fraudulent activity is suspected;

  • payment cannot be collected; or

  • the service is deliberately misused.

Where appropriate, we will notify you before taking such action.

10. Digital Content

By subscribing, you request that we begin creating personalised digital content as soon as your order is placed.

Nothing in these Terms affects your statutory rights under the laws of England and Wales.

11. Intellectual Property

All stories, website content, branding, graphics, logos and other materials remain the intellectual property of The Story Garden unless otherwise stated.

Stories are supplied for your personal, non-commercial use only.

You may:

  • Read and enjoy your stories.

  • Print copies for your own household.

  • Keep copies for personal use.

You may not:

  • Sell or licence the stories.

  • Publish them commercially.

  • Redistribute them for profit.

  • Claim them as your own work.

  • Remove copyright notices.

12. Story Sharing & Marketing

We may occasionally use excerpts or complete stories for marketing, promotional or educational purposes, including on our website, social media channels, advertising and other promotional materials.

Where we do so, we will remove or change identifying information, including your child’s name and any other personal details that could reasonably identify your child or family.

By using our service, you grant The Story Garden a non-exclusive, worldwide, royalty-free licence to use anonymised versions of stories created through the service for these purposes.

If you would prefer that your family’s stories are never used in this way, you may contact us at any time to opt out. We will honour future requests and will not use your stories in any new marketing materials after your request has been received.

13. Service Changes

We may update, improve or modify our services from time to time, including story formats, features and functionality.

These changes are intended to improve the experience for our subscribers.

14. Availability

We do our best to keep our website and services available at all times.

However, we cannot guarantee uninterrupted access and are not responsible for temporary interruptions caused by maintenance, technical failures or events beyond our reasonable control.

15. Suspension or Termination

We reserve the right to suspend or terminate a subscription if:

  • these Terms are breached;

  • fraudulent activity is suspected;

  • payment cannot be collected; or

  • the service is deliberately misused.

Where appropriate, we will notify you before taking such action.

16. Limitation of Liability

To the fullest extent permitted by law, The Story Garden shall not be liable for any indirect or consequential loss arising from the use of our service.

Nothing in these Terms excludes or limits liability where it cannot legally be excluded under applicable law.

17. Events Beyond Our Control

We shall not be responsible for delays or failure to perform our obligations where such delays or failures result from circumstances beyond our reasonable control. These may include, but are not limited to, internet outages, cyber incidents, natural disasters, industrial disputes, failures of third-party service providers or government action.

18. Changes to These Terms

We may update these Terms from time to time.

The latest version will always be available on our website.

By continuing to use the service after changes take effect, you agree to the updated Terms.

19. Governing Law

These Terms are governed by the laws of England and Wales.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
